Terms of Service
These Terms of Service ("Terms") govern your use of FetchPing ("the Service"), operated by Devon ("we", "us", or "our"). By creating an account or using the Service in any way, you agree to these Terms. If you do not agree, do not use the Service.
1. Accounts and eligibility
You must be at least 13 years old to use FetchPing. If you are using the Service on behalf of a company or other legal entity, you represent that you have the authority to bind that entity to these Terms.
You are responsible for maintaining the security of your account credentials. We are not liable for any loss or damage arising from unauthorised access to your account. You must notify us promptly at contact@fetchping.com if you believe your account has been compromised.
You may not create accounts by automated means, create accounts for fraudulent purposes, or share your account with others in a way that circumvents plan limits.
2. Acceptable use
You may use FetchPing to monitor services that you own or operate, or services you have explicit permission to monitor. You may not use the Service to:
- Monitor systems you do not have permission to access or probe.
- Conduct denial-of-service attacks, load testing, or stress testing against third-party systems.
- Send spam, unsolicited messages, or abuse alert channels.
- Probe or scan systems for vulnerabilities without authorisation.
- Circumvent, disable, or interfere with the security features of the Service.
- Use the Service in a way that violates applicable laws or regulations.
- Resell or sublicense access to the Service without our written consent.
- Reverse engineer, decompile, or attempt to extract the source code of the Service.
- Use automated tools to create accounts, manipulate statistics, or abuse free plan limits.
- Post or transmit content that is unlawful, harmful, threatening, abusive, defamatory, or otherwise objectionable.
We reserve the right to suspend or terminate accounts that violate these rules, with or without notice depending on the severity of the violation.
3. Plans, billing, and cancellation
Free plan
The free plan is provided without charge. We reserve the right to modify or discontinue free plan features at any time. Free accounts that show no activity for 60 consecutive days may have their monitors paused automatically.
Pro plan
The Pro plan is billed monthly at the rate displayed on the pricing page at the time of subscription. All fees are charged in US dollars and are non-refundable except where required by applicable law.
Your subscription renews automatically each month until you cancel. You can cancel at any time through your billing settings. Cancelling stops future renewals; you retain access to Pro features until the end of the current billing period.
Price changes
We may change the price of the Pro plan at any time. If we increase the price, we will give you at least 30 days notice by email before the change takes effect on your subscription. Continuing to use the Service after the effective date constitutes acceptance of the new price.
Taxes
The prices shown do not include applicable sales tax, VAT, or other taxes. You are responsible for any taxes applicable to your use of the Service in your jurisdiction.
Disputes
If you believe a charge is incorrect, contact us at contact@fetchping.com within 30 days of the charge. We will investigate and, if the charge was in error, issue a correction or refund.
4. Service availability
We aim to keep FetchPing running reliably, but we do not guarantee any specific level of uptime. The Service is provided "as is" and "as available". We may perform maintenance, upgrades, or emergency fixes that temporarily affect availability. We will try to give advance notice for planned maintenance where possible.
FetchPing is an uptime monitoring tool, not a guaranteed alerting system. Alerts depend on network connectivity, third-party services (email delivery, webhooks), and other factors outside our control. You should not rely solely on FetchPing for critical incident response without additional redundancy.
5. Your data
You retain ownership of all data you submit to FetchPing, including monitor configurations, targets, and account information. By using the Service, you grant us a limited licence to process and store your data for the purpose of providing the Service.
We will not sell your data to third parties. We use it only to operate and improve the Service, as described in our Privacy Policy.
Check history is retained according to your plan: 30 days for free accounts and 120 days for Pro accounts. Data older than your retention limit is deleted automatically.
You can export a copy of your account data, including monitors, status pages, alert channels, and incidents, at any time from your account settings. You can also permanently delete your own account from your account settings, which removes your data from our active systems immediately, except where we are required to retain certain records by law (for example, billing records).
6. Intellectual property
The FetchPing name, logo, software, and all content produced by us are our property and are protected by applicable intellectual property laws. You may not use our trademarks, logos, or branding without our written permission.
Any feedback, suggestions, or ideas you share with us may be used by us without any obligation to you.
7. Limitation of liability
To the fullest extent permitted by law, FetchPing and its operator shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to lost profits, lost data, or business interruption, arising out of or in connection with your use of the Service, even if we have been advised of the possibility of such damages.
Our total liability to you for any claims arising under these Terms shall not exceed the amount you paid us in the 12 months preceding the claim, or $100, whichever is greater.
Some jurisdictions do not allow the exclusion of certain warranties or the limitation of liability for certain types of damages. In those jurisdictions, our liability is limited to the maximum extent permitted by law.
8. Indemnification
You agree to indemnify and hold harmless FetchPing and its operator from any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.
9. Termination
You may stop using the Service at any time. Account deletion is self-serve from your account settings and is immediate and permanent once confirmed. We may also suspend or terminate your account if you violate these Terms, if your account poses a security or legal risk to us or other users, or if we discontinue the Service.
On termination, your right to use the Service ends immediately. We may retain certain data as required by law or for legitimate business purposes, but we will delete your personal data in line with our Privacy Policy.
10. Disputes and governing law
These Terms are governed by the laws of the jurisdiction in which the operator is based, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved through good-faith negotiation where possible. If a dispute cannot be resolved informally, it shall be subject to the exclusive jurisdiction of the courts in that jurisdiction.
If you are a consumer in a jurisdiction with mandatory consumer protection laws that cannot be waived by contract, those laws apply to the extent they conflict with these Terms.
11. Changes to these Terms
We may update these Terms from time to time. When we do, we will update the date at the top of this page. For significant changes, we will notify registered users by email at least 14 days before the changes take effect. Your continued use of the Service after that date means you accept the updated Terms.
If you do not agree with updated Terms, you must stop using the Service before they take effect.
